General Terms and Conditions for chaatendirect.com

The following Terms and Conditions govern the relationship between Media Buy Services Ltd., Arh. Georgi Nenov 25 str. office 1; 1324, Sofia (hereinafter "Media Buy Services Ltd.") and the users and customers of its telemedia Services (hereinafter "User"). They define the conditions under which the use of the Services offered by chaatendirect.com (hereinafter "Platform"). These Conditions of Use constitute a legally binding agreement between you and Media Buy Services Ltd. about your use of the Platform and the Website. If any of the aforementioned documents contain anything that you are not willing to agree to then you should not use the Platform or the Website.

1. Definitions

In these Conditions of Use, the capitalized terms set out below have the following meaning:

Account: the personal environment of the User within the Platform on which the User can place personal information and preferences, granting him access using his Login Details and which Profile is visible to other users of the Platform;

Message: the digital, secured communications that can be exchanged between the User and other users of the Platform if he has full access to the Platform and which communications are visible for the User in his Account;

Content: all material published and sent on the Platform by the User from time to time, including but not limited to the Profile, Messages and other material;

Service: the Entertainment service provided to the User by Media Buy Services Ltd.

Login Details: the combination of username and password, given by the User, giving the User access to the Account and enabling him to use the Platform;

Intellectual Property Rights: all intellectual property rights, such as copyrights, trademark rights, patent rights, design rights, trade name rights, databank rights and neighboring rights, as well as domain names and knowhow; and related rights

User: the natural person who created an Account, who has accepted these Conditions of Use and who can therefore use the Platform;

Conditions of Use: these conditions of use of chaatendirect.com, which form a binding agreement between the User and Media Buy Services Ltd.;

Party/Parties: Media Buy Services Ltd. and/or the User;

Platform: the software application which has been developed by Media Buy Services Ltd., which can be accessed via the Website and which can be used by the User after the latter has created an Account;

Privacy Statement: the privacy statement of Media Buy Services Ltd., which can be consulted on this website;

Website: the website of Media Buy Services Ltd., as well as all underlying pages, via which domain the User can gain access to the Platform;

2. Acceptance of the Contract Concerning the General Terms and Conditions

By creating an account on Platform or by using the Platform app, whether with a mobile device, a mobile application or a computer (collectively, the "Service"), the User agrees to the following Terms of Use.

Media Buy Services Ltd. may make changes to this Agreement and the Service from time to time. We may do this for a variety of reasons, such as to reflect changes in laws or regulations, new functions, or changes in business practices. The most current version is always the valid version. If the changes include significant changes that affect your rights or obligations, we will provide you with reasonable notice of those changes, by way of messages via the Service or by e-mail, for example. If you continue to use the Service after the changes take effect, you agree to the revised Agreement.

If any provisions of the Conditions of Use are null and void or are declared void, the other provisions of the Conditions of Use will remain in full force. Media Buy Services Ltd. will replace the void or voided provisions with new provisions, duly observing the objective and purport of the void or voided provisions as closely as possible.

3. Access

Access to the Media Buy Services Ltd. database and Services is granted after the User has registered. During registration, a password and pseudonym specified by the User are used. Registration requires the User to enter an e-mail address or phone number and completely fill in the registration form.

As an alternative, the User is offered a connect function from third-party providers (e.g. Facebook Connect). When registering via the connect function of a third-party provider, the respective profiles of the User are transferred to the Media Buy Services Ltd. database. When registering via the connect function of a third-party provider, the User must accept the respective terms and conditions of the third-party provider.

4. Scope of Services

Media Buy Services Ltd. enables Users to access a central database system via its mobile application. This database system contains profiles and information about other Users. After registering and creating their own profile, Users have the option of searching for other profiles in the database. Users can view the profiles of other Users and contact them. In addition, Media Buy Services Ltd. offers access to data from a selection of Users as part of its access to the database system. The content, type and duration of the data material provided and transmitted by the respective User is the sole responsibility of the User.

Media Buy Services Ltd. provides both free and paid Services. With the free registration, the User can create a profile, view the profiles of other Users and read messages from other Users. Likewise, a User can tag the profiles of other Users free of charge. If two Users tag each other's profile, this is shown to both Users. This is a so-called match.

In addition to the free Services listed above, the User is offered to contact other Users and write messages to them for a fee. Before these Services are provided, the User is informed of the costs, content and scope of the Services as well as the price and terms of payment.

It is not the objective of the Service to establish real-life contact between the User and other users of the Platform. Media Buy Services Ltd. therefore cannot guarantee in any way that such contact can indeed be established via the Platform. To facilitate user interaction Media Buy Services Ltd. uses paid moderators. This is not a hookup service. The point of service is for entertainment purposes only.

Use of the Service is permitted only for Users who have reached the age of 18. By accepting these Conditions of Use and using the Service, you confirm that you are at least 18 years of age. If the User has not yet reached that age, if he cannot agree with the content of the Platform and/or resides outside the geographical area on which the Service focuses, the User must immediately stop using the Service and terminate his Account. If the User acts in violation of this article, Media Buy Services Ltd. has the right to immediately remove the User's Account, without refunding Credits of the User.

Media Buy Services Ltd. explicitly reserves the right to create profiles on the Platform and to send messages to the User on behalf of these accounts. By accepting these Conditions of Use, the User understands and accepts that some of the profiles on the Platform are therefore fictitious and they have been created only to exchange Messages with; real-life meetings are not possible for such Accounts.

Media Buy Services Ltd. makes every effort to provide the Service prudently and professionally. The Service is at all times provided based on an obligation to use best endeavors. The User, therefore, accepts that the Platform only contains the functionalities and other properties as he finds them on the Platform at the time of use (on an "as is" basis). Media Buy Services Ltd. therefore explicitly excludes explicit and implicit guarantees, promises, and indemnifications of any nature concerning the Platform and the Website.

To use the Platform, the User must have the necessary hardware equipment and software and the necessary parameters required to properly use the website, for example access to the internet. Users are also advised to have JavaScript functions, cookies and pop-ups enabled. Although we are working to ensure that the Platform is compatible across various devices, we cannot guarantee that it will work on all devices and it is your responsibility to ensure that you can comply with all necessary system requirements. Your use of the Platform and enjoyment of its features and Content posted or made available through it may vary in functionality, availability, and quality depending on the type of device you use.

The User is at all times personally responsible for keeping his Login Details secret and the User is liable for all use made via his Login Details. As soon as the User knows or has reason to believe that his Login Details are held by unauthorized persons, he must notify Media Buy Services Ltd. accordingly by contacting support, without prejudice to his own obligation to immediately take effective measures, such as changing his Login Details.

The User is explicitly not permitted to create an Account in someone else's name or to create a fictitious Account. Media Buy Services Ltd. has the right to immediately remove such Accounts.

It is forbidden for the User to post contact details such as phone numbers, addresses, family names, URLs, e-mail addresses or other personal information. Media Buy Services Ltd. reserves the right to reject, modify, or delete any profile.

5. Authorization

Minors and persons acting on behalf of a third party are excluded from using Media Buy Services Ltd.'s Services. If Media Buy Services Ltd. has reason to suspect that a person is not entitled to participate, Media Buy Services Ltd. shall be entitled to verify the person's personal data by validating their identity by requesting official documents. Users who are not entitled to participate are excluded from using Media Buy Services Ltd.'s Services and the database.

By creating an account and by using the Service, the User declares and guarantees that:

• they can enter into a binding contract with Media Buy Services Ltd.;
• they will comply with this Agreement and all applicable local, state, national and international laws, rules and regulations; and
• they have never committed a serious crime or a punishable act (or a similar offense), a sexual crime, or a violent offense are not listed as a sex offender in any state, federal, or local sexual offender register.
• they are over 18 years old

Use of the Service is permitted only for Users who have reached the age of 18. By accepting these Conditions of Use and using the Service, you confirm that you are at least 18 years of age. If the User has not yet reached that age, if he cannot agree with the content of the Platform and/or resides outside the geographical area on which the Service focuses, the User must immediately stop using the Service and terminate his Account. If the User acts in violation of this article, Media Buy Services Ltd. has the right to immediately remove the User's Account, without refunding Credits of the User.

The User is explicitly not permitted to create an Account in someone else's name or to create a fictitious Account. Media Buy Services Ltd. has the right to immediately remove such Accounts.

6. Termination of the Free Membership

• A User is entitled to have their profile deleted at any time without stating reasons by contacting customer support
• In addition, Media Buy Services Ltd. reserves the right to refuse the registration of a User at any time without stating reasons
• If the User violates these General Terms and Conditions, Media Buy Services Ltd. may terminate the membership at any time without notice
• Upon termination of membership, all obligations of the operator to store data of the User cease, unless statutory retention periods require storage.

7. Modification of the Services

Media Buy Services Ltd. always strives to improve the Service and provide Users with additional functionalities that they find appealing and useful. This means that from time to time Media Buy Services Ltd. will introduce new product features or enhancements and remove some features, and if these measures do not materially affect the rights or obligations of Users, Media Buy Services Ltd. may do so without prior notice to Users. Media Buy Services Ltd. may even suspend the Service altogether, in which case Media Buy Services Ltd. will notify Users in advance unless mitigating circumstances, such as security concerns, prevent this.

8. Purchases

In addition to the free Services, Media Buy Services Ltd. offers the User various fee-based Services and benefits. With each individual use of these Services, the User enters a new contractual relationship with Media Buy Services Ltd.. Each use of a Service constitutes a new contractual relationship. These Services are completely detached from the free use of the Media Buy Services Ltd. database system. The individual contracts do not constitute subscriptions. The contract is concluded by the User selecting the chargeable Service and accepting the payment obligation by pressing the "Buy" button (hereinafter: Order Process). The Services subject to charges are also subject to local terms and conditions.

9. Return & Refund Policy

The User acknowledges that Media Buy Services Ltd. refund cases are handled by chaatendirect.com support department which can be reached at supp23@chaatendirect.com

All payments and refunds are processed through website's payment processor Verotel.

The User may terminate their membership with chaatendirect.com at any time.

Refunding transactions of Users of chaatendirect.com is governed by the following:

• In the event a User is no longer interested in the Services, chaatendirect.com customer support administrators shall review the correspondence between such User and other User's with whom the User has been corresponding (the «Correspondent») and shall have the right to make a decision, in their sole discretion, with respect to the issuance of refund back to the User.
• In the event of a (technical) breakdown at chaatendirect.com, a User can submit a written request for a refund of Credits that were spent as a result of that breakdown. In such cases, a refund will not be witheld on unreasonable grounds.

Deactivation of profiles of Users of chaatendirect.com is governed by the following:

• In the event a User is no longer interested in the Services, chaatendirect.com customer support administrators shall review the correspondence between such User and other User's with whom the User has been corresponding (the «Correspondent») and shall have the right to make a decision, in their sole discretion, with respect to the issuance of refund back to the User.
• In the event a User had requested his/her profile to be deleted from chaatendirect.com for unspecified personal reasons, the Correspondent shall not have the right to receive any information with respect to the deletion of such a User's profile, as it would be in violation of chaatendirect.com's Privacy Policy. Furthermore, the Correspondent shall not be entitled to any refund with respect to his correspondence with such a User.
• In the event, a User had been reported for inappropriate activities, chaatendirect.com may, at its sole and unfettered discretion, issue a partial refund to the Correspondent, who had informed chaatendirect.com of such User's inappropriate activity by providing incontrovertible evidence of same.
• In the event, a User is found on an anti-scam site, or in case we receive reliable proof of the User's illegal activities from another User, such User's profile may be deleted from the Website/Application provided that chaatendirect.com, in its sole and unfettered discretion, considers the supplied information substantial and irrefutable. chaatendirect.com may issue a partial refund to the Correspondent who provided such information.

10. Terms of Payment

• The fee for paid Services must be paid in advance to Media Buy Services Ltd. and is collected in full by the payment method selected in the Order Process, such as credit card, direct debit, online banking, Paysafe Card or PayPal. After successfully completing the Order Process, the coins will be credited to the customer account immediately, but at the latest after 2 hours.
• Media Buy Services Ltd. may have the payments for fee-based Services processed by an external Service provider appointed by Media Buy Services Ltd..

11. User Obligations

• The User is solely responsible for the content of their registration, further personal data and thus for the information they provide about themselves. The User affirms that the provided data are true and describe themselves personally. Intentional or fraudulent misrepresentations may result in civil and criminal proceedings and entitle Media Buy Services Ltd. to block the User profile without affecting Media Buy Services Ltd.'s right to remuneration.
• The User affirms that they do not use Media Buy Services Ltd.'s Services for business or commercial purposes, in particular for advertising purposes. The User is not permitted to read out the contents and profiles of other Users manually or with computer programs to use the data obtained in this way.
• The User commits themselves to treat their login data confidentially. If the login data is passed on to third parties, the User is responsible for all consequences of the action. If it is suspected that the access data has been forwarded to third parties, the User must inform Media Buy Services Ltd. immediately and take appropriate measures to prevent further misuse (e.g. by changing the password).
• Furthermore, the User commits to not abusing Media Buy Services Ltd.'s Services, in particular,
  • not to use them to disseminate defamatory, racist, inciting or otherwise illegal material or information;
  • not to request illegal pornography via the database system or from other Users;
  • not to use them to threaten or harass other Users or performers or to violate their rights (including personal rights);
  • not to introduce any data into the system or the database which contain a virus, software, or other material which is protected by copyright or other protective rights, unless the User is the owner of the respective rights or has the necessary consent for use;
  • not to use them in such a way as to adversely affect the availability of the Services to other Users;
  • not to intercept any e-mails or other messages and not to attempt to do so;
  • not to send chain letters;
  • not to send any e-mails or other messages which serve a commercial purpose;
  • not to mention any names, addresses, telephone or fax numbers, messenger addresses, emails or URLs in the profile data;
  • not to collect, store or process any personal data about other Users.
• Non-compliance with the above obligations or a violation of other obligations regulated in these General Terms and Conditions shall entitle Media Buy Services Ltd. to immediately block the User's access to the database and to terminate the contract without notice for compelling reasons.
• If the User connects commercial or business interests with the conclusion of the contractual relationship or uses the data made available to them for business or commercial purposes or for purposes not expressly approved by Media Buy Services Ltd., they commit themselves to pay Media Buy Services Ltd. a contractual penalty of € 1,000 for each proven infringement. Further claims for damages remain unaffected by this.
• The User is also obliged to follow Media Buy Services Ltd.'s photo/picture policy.

12. Violation of User Obligations

If the User violates these General Terms and Conditions, Media Buy Services Ltd. may terminate the membership at any time without notice and the User's account will be deleted.

13. Content

The User is not permitted to use content published on the Platform by other users, such as their profiles or messages, in a way that is not in line with the objective set out in Article 3.2 and/or for use other than personal use.

The User understands and accepts that the Content he publishes on the Platform can be seen by other users of the Platform and that it can be used by these users and Media Buy Services Ltd. does not accept any liability for such use.

The User is never permitted to publish or otherwise distribute content via the Platform, which content i) infringes or may infringe the rights of Media Buy Services Ltd., other users of the Platform and/or a third party, including Intellectual Property Rights and rights in the field of privacy, ii) contains illegal content or refers to such content, iii) may harm the reputation of Media Buy Services Ltd., iv) contains content of a defamatory, insulting, obscene, hurtful or violent nature, or otherwise violates prevailing standards of decency, this at the discretion of Media Buy Services Ltd., or v) is otherwise unlawful. The User is personally and fully responsible for all damage ensuing from violating this guarantee.

This Website or Service is for adult entertainment purposes; it is not our aim to bring physical appointments/contact between members. The user is aware and agrees that we may use moderated and fictive profiles for online adult entertainment purposes. Media Buy Services Ltd. expressly reserves the right to send messages to this site by self-created profiles. Physical contact with these fictive profiles is not possible. Media Buy Services Ltd. denies itself of all liability to the extent that is allowed by the law and assumes no warranty for any kind of damage or inconvenience caused by the Service.

Media Buy Services Ltd. reserves the right to refuse Content, such as the photo published by the User, if this is necessary for the opinion of Media Buy Services Ltd., without this in any way constituting any right for the User to claim compensation and/or a refund, and/or liability of Media Buy Services Ltd.. Published Content will be removed from the Platform by the procedure set out in Article 11.

Users are urged to notify us of inappropriate Content. You acknowledge that such notification may take place and that we may take steps outlined in these Conditions of Use in respect of such information which comes to our attention.

14. Communication

• Media Buy Services Ltd. sets up an electronic mailbox for the User under their account/profile. This serves to contact other Users and to transmit Service messages from Media Buy Services Ltd.. Further communications from Media Buy Services Ltd. to the User shall be made via the e-mail address provided by the User.
• The Users of the Media Buy Services Ltd. database are provided with a chat for the mutual exchange of information in text form, as well as gifts and kisses for making contact. The Users themselves are responsible for managing the communication among each other and for ensuring an appropriate way of expression. Sexually objectionable statements at the start and hints during communication should be avoided.
• A chat can be started by the User at any time. Users who have a predefined number of "Coins" can write to other Users for a fee.
• A User receives push notifications by default. Notifications include notices of received chat messages, visits to the profile by other Users, tags of the profile by other Users, and matches. The notifications can be turned off in the settings of the app.
• Media Buy Services Ltd. uses professional animators and operators for the entertainment of the Users, who are not identified separately in the system. This Service is provided in the highest quality. Real meetings are not possible with these operators. Users can only send them messages within the portal.

15. Advertising and Newsletters

By registering with Media Buy Services Ltd., the User expressly agrees that messages with information about the Platform as well as information about other Users may be sent to them. The User is entitled to stop the mailing at any time.

16. Bans on Commercial or Business Use, Ban on Spamming

• The User assures that they are not pursuing any commercial and / or business interests in connection with their use. They commit themselves to not using the Platform website and the mobile app for commercial or business purposes.
• Advertising for commercial or business Internet pages or apps, in particular those that:
  • Offering of goods or services for monetary value, the solicitation of an equivalent offer or the reference to an equivalent offer which can be obtained elsewhere
  • Advertising for commercial or business websites or apps, in particular those
    • offer goods or services against payment,
    • are used for the presentation or advertising of companies, or
    • advertise other commercial portals.
    • This applies in particular to the advertising of companies in the form of pop-ups, banner advertising, or through especially highlighted or conspicuous links An internet page is considered commercial if it links directly or indirectly to the commercial internet portal of another operator.
  • Establishing contact to make a subsequent profit, in particular through subsequent references to 0900 numbers or premium rate SMS numbers.
• The User commits themselves not to advertise commercial offers to other Users of the Service offered here or to other Users in any form and not to send messages that serve a commercial or business purpose. This also refers to setting or naming links in publicly accessible profiles or sending messages with the internal message exchange systems (e.g. message posting, forums and profile data).

17. Damages

• A User who pursues or uses Platform for commercial or business purposes within the meaning of point 12 without the permission of Media Buy Services Ltd. is obliged to pay a flat-rate compensation of € 5,100. In this case, the User is permitted to prove that no damage has been caused at all or that it is significantly less than the lump sum. Media Buy Services Ltd. reserves the right to prove that it has suffered higher damages as a result.
• In the event of an intentional or grossly negligent breach of the User obligations mentioned under point 8, the User commits to pay damages to Media Buy Services Ltd., unless the breach already constitutes a lump-sum compensation according to paragraph 1 of this point. In this case, the User is permitted to prove that damage has occurred at all.

18. Third-party Services

The Service may contain advertisements and promotions offered by third parties as well as links to other websites or internet resources. Media Buy Services Ltd. is not responsible for the availability (or lack of availability) of such external websites or internet resources. If the User decides to interact with third parties through Media Buy Services Ltd.'s Services, the relationship between them and the User is subject to the terms and conditions of these third parties. Media Buy Services Ltd. is not responsible or liable for the terms or actions of such third parties.

19. Amendment of the General Terms and Conditions

Media Buy Services Ltd. reserves the right to amend these General Terms and Conditions at any time, insofar as this does not affect essential provisions of the contractual relationship and it is necessary to adapt to developments that were not foreseeable for Media Buy Services Ltd. at the time of conclusion of the contract and the non-observance of which would noticeably disturb the balance of the contractual relationship. Essential provisions are, in particular, those relating to the type and scope of the agreed Services as well as the term, including the provisions on termination. Media Buy Services Ltd. is entitled to make changes to close any gaps in the contract, in particular due to legal changes and changes in case law.

20. Liability of Media Buy Services Ltd.

• Media Buy Services Ltd. assumes responsibility or liability for the accuracy and security of the data and content published or transmitted by other Users. While Media Buy Services Ltd. makes every effort to ensure that the information provided by Users is correct, it cannot guarantee the accuracy of User profiles. Although this is not permitted, Users may enter incorrect or illegal information and content or use Media Buy Services Ltd.'s Services for inappropriate or illegal purposes.
• Media Buy Services Ltd. provides an IT service with access to the database and does not guarantee success. As Media Buy Services Ltd. has no influence on the transmission of data via the internet outside its own IT infrastructure, and due to the characteristics and uncertainties of the internet, Media Buy Services Ltd. cannot accept any liability for such external data losses and/or errors in data transmission. Media Buy Services Ltd. is not liable for any failure of the offer which is beyond its control (e.g. due to force majeure or technical malfunctions of the internet).
• Media Buy Services Ltd. assumes no liability for the misuse of information provided by the User to third parties. Media Buy Services Ltd. is also not liable for the unauthorized access of third parties to the personal data of Users (for example through unauthorized access to the central database), unless Media Buy Services Ltd. has deliberately or grossly negligently made the unauthorized access by third parties possible.
• Media Buy Services Ltd.is only liable - except in the case of breach of essential contractual obligations, in the case of injury to life, body, or health, or the case of claims arising from the Product Liability Act - for intent and gross negligence. Essential contractual obligations are those whose fulfillment is necessary to achieve the purpose of the contract.
• In the event of a minor negligent breach of an obligation which is essential for achieving the purpose of the contract (cardinal obligation), Media Buy Services Ltd.'s liability shall be limited in amount to the damage which is foreseeable and typical for the type of activity in question.
• The above limitation of liability also applies to the personal liability of Media Buy Services Ltd.'s employees, representatives and agents.

21. Rights

• The User grants Media Buy Services Ltd. a non-exclusive, transferable, geographically unlimited and temporally limited right of use to the contents created or uploaded by them on the database, including pictures, texts and videos.
• The User assures that the contents posted or created by them and their use do not infringe the rights of third parties, in particular copyrights or other property rights.

22. Data Protection

Media Buy Services Ltd. collects, processes, and uses the personal data of the User as described in these Terms and Conditions and the Privacy Policy. The storage of personal data is governed by the statutory provisions.

23. Cancellation Instruction

Right of Cancellation

The User has the right to cancel the created contracts within fourteen days without stating reasons. The revocation period is fourteen days from the day of the individual conclusion of the contract. In order to exercise the right of cancellation, the User must inform us (Media Buy Services Ltd., Arh. Georgi Nenov 25 str. office 1; 1324, Sofia, via email at supp23@chaatendirect.com) by means of an unambiguous statement (e.g., a letter sent by email) of their decision to cancel this contract. To comply with the withdrawal period, it is sufficient for the User to send notification of exercising the right of cancellation before the cancellation period expires.

Consequences of Cancellation

Upon cancellation of this Agreement by the User, we shall reimburse them for all payments we have received from them, including delivery costs (with the exception of any additional costs resulting from the User choosing a method of delivery other than the least expensive type of standard delivery offered by us). This reimbursement will be made without undue delay and at the latest within fourteen days from the day on which we received the notification of cancellation of this Agreement. We will use the same means of payment for this reimbursement as the User used for the original transaction, unless expressly agreed otherwise with the User; in no event will the User be charged fees for this reimbursement.

However, if the User has requested the commencement of the Service within the cancellation period, they are required to pay for the services actually provided until the time of cancellation. This amount will be proportional to the services rendered in relation to the total scope of services provided for in the Agreement. If the services are fully rendered before the cancellation is made, the User's right to a refund may be limited or not applicable.

Exceptions to Refund Policy

Please note that certain transactions may be exempt from full reimbursement under our refund policy:

1. If the User has expressly requested the start of the service within the cancellation period and the service has been fully performed, we reserve the right to withhold refunds as the service has been fully consumed.
2. For digital content not supplied on a tangible medium, if the performance has begun with the User’s prior express consent and acknowledgment that they thereby lose their right of cancellation.
3. Any other exceptions as may be stipulated by applicable law or in specific terms and conditions related to the service or product purchased.

If the User has given their express consent, the right of cancellation expires prematurely if the Service requested by the User has been completely provided by Media Buy Services Ltd. before the User has exercised their right of cancellation.

24. Reporting unlawful Content

Media Buy Services Ltd. is monitoring the Messages exchanged between the User and other users. Subject to the conditions set out below and after having received a relevant notification, Media Buy Services Ltd. will merely remove indisputably unlawful Content or stop an indisputably unlawful activity.

Media Buy Services Ltd. has set up a procedure under which the presence on or accessibility via the Platform of suspected unlawful material or suspected unlawful activities can be reported to Media Buy Services Ltd.. Media Buy Services Ltd. reserves the right not to honor a request to block Content or stop an activity, if it has good reason to doubt the correctness of the notification or the lawfulness of the evidence provided or if so demanded by a balancing of interests. The person making the notification indemnifies Media Buy Services Ltd. against every third-party claim in connection with the blocking or removal of material or activities being stopped. The indemnification also relates to all damage and costs incurred or to be incurred by Media Buy Services Ltd. or which it has to incur in connection with such a claim, including but not limited to compensation for the costs of legal aid.

All personal information it receives within the framework of a notification will always be processed following the Data Protection Act 1998 and will only be used for the processing of the notification.

The place of jurisdiction for all claims arising from this contract is Venlo, insofar as the User is not a customer. The applicability of mandatory regulations of the state in which the User has their habitual residence or domicile at the time of conclusion of the contract remains unaffected.
• Should individual provisions of these General Terms and Conditions be invalid or incomplete, the validity of the remaining General Terms and Conditions shall remain unaffected.
